MAJOR DEVELOPMENTS IN THE Reggie Clemons Case! 

1. It’s been discovered that the Missouri Attorney General’s office, who is prosecuting Reggie’s case, has been listening in on his legal calls. That is a serious client/attorney confidentiality violation. A hearing is scheduled for this coming Friday, June 23, 2017 at 1pm to discuss appointing a Special Master to investigate the AG’s office illegal conduct. If a breach is proven, it will disqualify the AG’s office from prosecuting the case.

2. The AG’s office claims to have DNA evidence in the case it wants to submit for trial. However, Reggie’s lawyers were assigned to his case only a little over a month ago; which does not give them sufficient time to thoroughly have the so-called evidence analyzed. Therefore, the defense has requested a continuance (postponement) of the August 2017 scheduled trial which the judge has already denied. Thus, the supposed DNA evidence the State claims to have could be declared inadmissible!

THOMAS CUMMINS  FILED POLICE BRUTALITY LAWSUIT AGAINST  THE METROPOLITAN POLICE DEPARTMENT OF THE CITY OF ST. LOUIS; NAMES DET. CHRIS PAPPAS IN SUIT.  HE WAS AWARDED A $150,000 SETTLEMENT!

THOMAS CUMMINS (COUSIN OF KERRY SISTERS AND ORIGINAL SUSPECT IN CASE), LIKE REGGIE, ACCUSED SEVERAL MEMBERS OF THE ST. LOUIS POLICE DEPARTMENT OF POLICE BRUTALITY DURING HIS 1991 INTERROGATION. REGGIE PLEADS THE FIFTH 

Reggie plead the 5th on several questions asked by the State at the advice of his attorneys. It is important to note that former prosecutor NELS MOSS DISMISSED the RAPE and FELONIOUS RESTRAINT charges against Reggie AFTER his wrongful Conviction in 1993. See Document below:

So the State asking Reggie questions at the hearing regarding the *****”alleged” rapes was trickery and attempted entrapment. Reggie was asked questions about proceedings he was NEVER CONVICTED OF.   Judge Manners later that day allowed Reggie to take the stand and answer a few questions he had pled the 5th to from his lawyer.

On Wednesday, Clemons refused to answer 29 questions from the state on grounds his answer could incriminate him. Initially, he pled the 5th Amendment 32 times, but after Judge Michael Manners encouraged him to meet with counsel to rethink his decision, Clemons answered three of those questions.

Previously, he answered four questions about the crimes posed by Andrew Lacy of his legal team: “Did you kill Robin or Julie Kerry?” “Were you aware of any plan to kill Robin or Julie Kerry?” “Did you intend to kill Robin or Julie Kerry?” “Did you intend to assist in the killing of Robin or Julie Kerry?

To all four questions, Clemons answered, “No.”

Moss to cops: ‘Omit’

Moss repeatedly wrote “omit” on the margins of the May 6, 1991 draft police report of Cummins’ interrogation, apparently ordering the detective sergeant preparing the final report to omit evidence that would be damaging to the person who was by then Cummins’ “star witness,” as Levine noted in court. In fact, the final police report prepared on May 31, 1991 and introduced in Clemons’ trial did make many of the changes ordered by Moss.

In the May 6 draft report, police claimed, “Thomas stated the truth was he tried to have sex with Julie, however she refused.” Moss ordered the report revised to state that it was detectives who suggested to Cummins that his intentions were sexual. “D. suggested he tried to have sex, etc.,” Moss noted (and he testified on the stand that the notes were his). Indeed, the final police report introduced as evidence at trial has the police planting in Cummins’ mind the suggestion that he wanted to have sex with his cousin, but “in his mind the overt act was not sexual.” In the final May 31 police report, Cummins went to hug his cousin and she fell off the bridge; whereas in the May 6 draft report that jurors never saw, Cummins made a sexual pass at her and then pushed her off the bridge when her rejection led to an argument.

Due to Moss’ revisions to the draft police report, his star witness went from a confessed murderer to a confessed hugger.

The May 31, 1991 police report was introduced as evidence at trial; the May 6 draft police report with Moss’ annotations was withheld, though defense lawyers repeatedly asked Clemons for “all exculpatory evidence,” all evidence likely to help the defense case, and specifically asked for the annotated May 6 draft report in a pre-trial motion.

Levin quoted from Moss speaking at that pre-trial hearing, saying untruthfully, “Look at the (final) police report. It’s in there. Nothing was edited. Nothing was omitted.”

As Levine argued, the annotated May 6 draft police report that was withheld from trial was crucial evidence showing that the prosecution’s “star witness” was an unreliable witness who kept changing his story and had a motive for an assault (a rejected incestuous sexual advance). Levine said it also showed that the prosecutor was willing to tamper with evidence to improve his case.

Levin said the trial jury was denied clear documentary evidence that “the prosecutor tried to fabricate evidence and keep it from the defense.”

Reggie is an innocent man who has been on death row under extreme restrictions for 20 years. In 1991, at the age of 19 he was taken from his home by police under the false pretense that they just wanted to question him about the murders of two sisters that took place on the Chain of Rocks bridge. Despite the insistence from his mother to obtain a lawyer first, the police assured her that Reggie would be fine and would return home later that day.  He has not been back home since.

While in custody, Reggie was beaten by police for  7 hours and denied his right to an attorney! Reggie feared for his life and finally broke down and confessed to raped but he refused to confess to murder. He had faith in the legal system that he would get due process and be fully exonerated because he is innocent.

Last year, “new evidence” surfaced in Reggie’s case and was submitted for DNA testing. The evidence includes  a rape kit supposedly taken from the corpse of one of the victims. The rape kit is still being tested which has caused Reggie’s hearing to again be rescheduled. This time for March 5, 2011. According to Reggie’s lawyers, they are confident that the kit confirms what has already been established, that there is no physical evidence connecting Reggie to the crimes.
